Madwoman's Game — Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Madwoman's Game documentary film website (the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site.

1. Introduction

The Site is operated for the promotion, exhibition, and support of the documentary film Madwoman's Game and related projects and activities. These Terms apply to all visitors, users, and others who access or use the Site. By accessing any page of the Site, you agree to comply with and be bound by these Terms, as well as any additional terms and policies referenced here or made available on the Site.

2. Intellectual Property

All content on the Site, including without limitation text, graphics, logos, photographs, audio recordings, video clips, cinematographic materials, artwork, designs, and the selection and arrangement thereof (collectively, the “Content”), is the exclusive intellectual property of the respective copyright holders associated with Madwoman's Game, or is used with their permission.

Except as expressly permitted in these Terms or otherwise authorized in writing, any unauthorized use, reproduction, modification, downloading, storage, transmission, distribution, display, performance, or creation of derivative works based on any Content from the Site is strictly prohibited. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in or accompanying the Content.

The Madwoman's Game name, logo, title treatment, and all related names, marks, designs, and slogans are protected trademarks or service marks of their respective owners (collectively, the “Marks”). You may not use any Marks without the prior express written consent of the applicable rights holder, including in any manner that is likely to cause confusion, dilute distinctiveness, or imply sponsorship or endorsement where none exists.

3. Permitted Use

You may access and use the Site and its publicly available Content solely for your personal, non-commercial, informational, and entertainment purposes, and always in accordance with these Terms and applicable law.

Press and media professionals may use certain still images, trailers, and approved press assets for bona fide editorial coverage of Madwoman's Game, provided that: (a) such use is non-commercial and directly related to news or editorial reporting; (b) all materials are used with proper and conspicuous attribution to the film and the relevant rights holders; and (c) any additional usage conditions communicated with those materials are strictly followed.

You agree that you will not, and will not permit or encourage any third party to: (a) use any automated tools, bots, crawlers, or scraping technologies to access, query, or collect data or Content from the Site; (b) engage in bulk downloading or systematic archiving of the Site or its Content; (c) interfere with or attempt to interfere with the proper functioning, security, or integrity of the Site; or (d) use the Site or its Content for any illegal, abusive, infringing, or unauthorized purpose.

4. Giveaway Terms

From time to time, the Site may host promotional giveaways, sweepstakes, or contests (collectively, “Giveaways”). Each Giveaway may be subject to its own official rules, terms, and eligibility requirements (the “Official Rules”). In the event of any conflict between these Terms and the Official Rules for a particular Giveaway, the Official Rules will govern for that Giveaway.

Giveaways are void where prohibited or restricted by law. Eligibility may vary by jurisdiction and may be subject to age or residency requirements as stated in the applicable Official Rules. By entering any Giveaway, you represent that you meet all eligibility requirements and that your participation does not violate any applicable laws, regulations, or policies.

Certain Giveaways on the Site may be administered using Gleam, a third-party giveaway platform. By participating in a Giveaway hosted or administered through Gleam, you also agree to be bound by Gleam's applicable terms of service, privacy policy, and rules, in addition to these Terms and any Official Rules for that Giveaway. We are not responsible for Gleam’s operations, data handling practices, or technical performance.

For the signed chess board Giveaway associated with Madwoman's Game (the “Chess Board Giveaway”), the following additional terms apply, in addition to the applicable Official Rules:

One (1) winner will be selected at random from eligible entries received during the stated entry period.
The prize consists solely of the signed chess board described in the Official Rules. The prize is non-transferable, non-assignable, and may not be substituted or exchanged for cash or any other consideration.
The winner is solely responsible for any and all federal, state, provincial, local, or other taxes, duties, or fees that may be imposed in connection with the receipt or use of the prize, as well as any incidental costs not expressly described as included.
We may require the winner to complete and return any necessary documentation (such as an affidavit of eligibility, liability/publicity release, or tax forms) as a condition of receiving the prize.

Madwoman's Game and the applicable rights holders reserve the right, in their sole discretion and at any time, to cancel, suspend, or modify any Giveaway (in whole or in part), or to disqualify any participant, if fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Giveaway or if required by applicable law or regulation.

5. Press & Media Inquiries

Press and media inquiries regarding Madwoman's Game, including requests for screeners, press screeners, media kits, and other promotional materials, may be submitted through the Press Contact form or other channels indicated on the Site. Access to screening links, screeners, or any restricted materials is granted strictly at our sole discretion and may be revoked at any time without notice.

Any materials provided for press or media purposes, including screeners, stills, trailers, press notes, and artwork, are provided solely for use in authorized editorial or critical coverage of the film or related projects. Except as explicitly authorized in writing, such materials may not be redistributed, uploaded, broadcast, or published in full, nor may they be edited or altered in a manner that is misleading, defamatory, or inconsistent with the spirit of the work.

Interview requests with filmmakers, talent, or representatives of Madwoman's Game are subject to availability, scheduling constraints, and our editorial discretion. We make no commitment that any particular request will be granted, and we may decline or withdraw any previously granted interview at any time for any reason.

6. Newsletter

The Site may offer a newsletter or similar email communications (the “Newsletter”) featuring updates, announcements, and related content about Madwoman's Game and associated projects. The Newsletter is operated and delivered via Beehiiv, a third-party email and publishing platform.

By subscribing to the Newsletter, you consent to the collection and processing of your information by Beehiiv and agree to be bound by Beehiiv’s applicable terms of service and privacy policy, in addition to these Terms. We do not control and are not responsible for Beehiiv’s independent practices or policies.

You may unsubscribe from the Newsletter at any time by using the unsubscribe link provided in the emails or by following any other unsubscribe instructions provided. Unsubscribing from the Newsletter will not necessarily affect other communications that you have separately agreed to receive, where applicable.

7. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and all Content, services, features, and materials made available through the Site are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express, implied, or statutory.

Without limiting the foregoing, we expressly disclaim any and all implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure, free of errors, viruses, or other harmful components, or that any defects will be corrected.

We make no representations or warranties regarding the accuracy, completeness, timeliness, or reliability of any Content made available on or through the Site, or regarding the availability of any screenings, giveaways, or other opportunities mentioned on the Site. Your use of the Site is at your sole risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Madwoman's Game, the filmmakers, producers, distributors, or any of their respective owners, officers, directors, employees, agents, partners, licensors, or representatives (collectively, the “Madwoman's Game Parties”) be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your access to, use of, or inability to use the Site or any Content, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if the Madwoman's Game Parties have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, the total aggregate liability of the Madwoman's Game Parties for any and all claims arising out of or in connection with these Terms or your use of the Site will not exceed, in the aggregate, the greater of (a) the amount, if any, that you have paid directly to us in connection with your use of the Site during the six (6) months immediately preceding the claim, or (b) one hundred U.S. dollars (USD $100.00).

Some jurisdictions do not allow certain disclaimers or limitations of liability. In such jurisdictions, the foregoing disclaimers and limitations will apply only to the extent permitted by the laws of such jurisdiction.

9. Third-Party Links and Services

The Site may contain links to third-party websites, services, platforms, or resources, including but not limited to Gleam, Beehiiv, social media platforms, streaming services, ticketing platforms, and press platforms (collectively, “Third-Party Services”). These Third-Party Services are provided solely as a convenience, and we do not endorse, control, or operate them.

You acknowledge and agree that we are not responsible or liable for the availability, content, advertising, products, services, policies, security, or practices of any Third-Party Services, or for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such Third-Party Services. Your use of Third-Party Services is subject to the separate terms and conditions and privacy policies of those third parties.

10. Changes to the Site and to These Terms

We reserve the right, at any time and in our sole discretion, to modify, suspend, or discontinue any aspect of the Site, including any Content, features, or availability, with or without notice and without liability to you.

We may revise or update these Terms from time to time. When we do so, we will update the Effective Date set out below. Any changes will become effective upon posting the updated Terms on the Site, unless otherwise specified. Your continued access to or use of the Site after the updated Terms have been posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.

11. Governing Law and Jurisdiction

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any Content (whether in contract, tort, or otherwise) will be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law principles. The specific governing law and venue for any disputes may be further specified in other agreements or notices provided on the Site.

Where permitted by law, you agree that any dispute arising under or in connection with these Terms or your use of the Site will be resolved exclusively in the courts of a competent jurisdiction, and you consent to the personal jurisdiction and venue of such courts. Nothing in these Terms will prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
